I. General Terms

• Terms – these terms of service
• Service – the "ZYNT" web service, operating at https://getzynt.com
• Service Provider – company "2WM" with registered address: ul. Świętego Mikołaja 8/11 lok. 208, 50-125 Wrocław, Tax ID: 8971943352
• User – any natural person who gains access to the Service and uses services provided through the Service by the Service Provider
• Electronic Communication – Communication between parties via email and contact forms available on the website

II. General Provisions

• The Terms define the principles of operation and use of the Service and determine the scope of rights and obligations of Users and the Service Provider related to the use of the Service.
• The subject of the Service Provider's services is providing free tools in the form of the Service, enabling Users to access content in the form of posts, articles and audiovisual materials or web applications and electronic forms.
• Any content, articles and information containing features of tips or advice published in the Service are only a general collection of information and are not directed to individual Users. The Service Provider is not responsible for their use by Users.
• The User takes full responsibility for the manner of using materials made available within the Service, including for using them in accordance with applicable law.
• The Service Provider does not provide any warranty as to the suitability of materials placed in the Service.
• The Service Provider is not liable for any damages suffered by Service Users or third parties in connection with using the Service. All risks associated with using the Service, and in particular with using and utilizing information placed in the Service, are borne by the User using the Service's services.

III. Terms of Service Use

• Using the Service by each User is free and voluntary.

• Users are obliged to familiarize themselves with the Terms and other documents constituting its integral part and must accept all its provisions in order to continue using the Service.

• Users may not use any personal data obtained in the Service for marketing purposes.

• Technical requirements for using the Service:

  • device with a display enabling the display of web pages
  • internet connection
  • any web browser that displays web pages in accordance with W3C Consortium standards and provisions and supports HTML5 websites
  • enabled JavaScript support
  • enabled Cookie support

• In order to ensure the security of the Service Provider, Users and other Users using the Service, all Users using the Service should comply with generally accepted network security principles.

• The following actions performed personally by Users or using software are prohibited:

  • without written consent, decompilation and analysis of source code
  • without written consent, causing excessive load on the Service server
  • without written consent, attempts to detect vulnerabilities in Service security and server configuration
  • attempting to upload or inject code, scripts and software onto the server and database that could damage the Service software, other Users or the Service Provider
  • attempting to upload or inject code, scripts and software onto the server and database that could track or steal data from Users or the Service Provider
  • taking any actions aimed at damaging, blocking the operation of the Service or preventing the realization of the purpose for which the Service operates

• In case of detecting the occurrence or potential possibility of a Cybersecurity incident or GDPR violation, Users should first report this fact to the Service Provider in order to quickly remove the problem/threat and secure the interests of all Service Users.

IV. Registration Terms and Conditions

• Users can use the Service without the need for registration.
• Users must be registered and have an account in the Service to use additional services provided in the Service, available only to Users after logging in.
• Registration in the Service is voluntary.
• Registration in the Service is free.
• Each User may have only one account in the Service.
• Technical requirements related to account registration:
  • having an individual email account
• Users registering in the Service consent to the processing of their personal data by the Service Provider to the extent that they were entered into the Service during the registration process and their subsequent changes or deletion.
• The Service Provider has the right to suspend or delete User accounts at its own discretion, thus preventing or limiting access to individual or all services, content, materials and resources of the Service, especially if the User violates the Terms, generally applicable legal provisions, principles of social coexistence or acts to the detriment of the Service Provider or other Users, justified interest of the Service Provider and third parties cooperating or not with the Service Provider.
• All Service services may be changed in terms of their content and scope, added or removed, as well as temporarily suspended or access to them may be limited, according to the free decision of the Service Provider, without the possibility of Users raising objections in this regard.
• Additional security principles regarding account use:
  • Users registered in the Service are prohibited from sharing their login and password to their account with third parties.
  • The Service Provider has no right and will never request a User's password to the selected account.
• Account deletion:
  • Each User with an account in the Service has the ability to independently delete the account from the Service.
  • Users can do this after logging into the panel in the Service.
  • Deleting an account results in the deletion of all User identification data and anonymization of the username and email address.

V. Newsletter Service Terms

• Users can use the Service without the need to subscribe to the Newsletter.
• Subscribing to the Newsletter service is voluntary.
• Subscribing to the Newsletter service is free.
• Technical requirements related to the Newsletter service:
  • having an individual email account
• Newsletter service terms:
  • providing an individual email account in the electronic form
  • verification of the provided email account by activating the link sent to it
  • consent to receive email notifications
• Newsletter service scope:
  • notifying about new updates, posts, contests, and other promotional activities related to Service services
  • notifying about promotional activities of Service partners (Marketing messages)
• Unsubscribing from the Newsletter service:
  • Each User subscribed to the Newsletter service has the ability to independently unsubscribe from the Service.
  • Users can do this via a link placed in each sent email message.
  • Unsubscribing from the Newsletter service results in the removal of the provided email address from the Service Provider's database.

VI. Communication Terms and Other Service Provisions

• The Service provides services and tools enabling Users to interact with the Service in the form of:
  • Contact form
  • Commenting on posts and articles
  • Publishing own content in the form of posts and articles
  • Publishing own content in the form of graphic and multimedia materials
• The Service provides contact data in the form of:
  • Email address
  • Contact phone
• In case of User contact with the Service Provider, Users' personal data will be processed in accordance with the "Privacy Policy", which is an integral part of the Terms.
• Terms for posting content by Users in the Service:
  • It is prohibited to post offensive or defamatory content in the Service regarding the Service Provider, other Users, third parties and third party entities
  • It is prohibited to post text, graphic, audiovisual materials, scripts, programs and other works in the Service for which the User does not have a license, or whose copyright holder has not consented to free publication
  • It is prohibited to post vulgar, pornographic, erotic content and content inconsistent with Polish and European law in the Service, as well as links to sites containing such content
  • It is prohibited to post scripts and programs that excessively load the server, illegal software, software used to violate security and other similar activities in the Service, as well as links to sites containing such materials
  • It is prohibited to post marketing content and advertising other commercial services, products, services or commercial websites in the Service

VII. Data Collection About Users

In order to properly provide services through the Service, secure the legal interest of the Service Provider and to ensure compliance of the Service with applicable law, the Service Provider collects and processes some data about Users through the Service.

In order to properly provide services, the Service uses and stores some anonymous information about the User in cookie files.

The scope, purposes, method and principles of data processing are available in the attachments to the Terms: "GDPR Information Obligation" and in the "Privacy Policy", which are an integral part of the Terms.

• Automatically collected data: For the smooth operation of the Service and for statistics, we automatically collect some data about the User. This data includes:

  • IP address
  • Browser type
  • Screen resolution
  • Approximate location
  • Opened subpages of the service
  • Time spent on the appropriate subpage of the service
  • Operating system type
  • Previous subpage address
  • Referring page address
  • Browser language
  • Internet connection speed
  • Internet service provider
  • Anonymous demographic data based on Google Analytics data:
    • Gender
    • Age
    • Interests
  • Anonymous data necessary for serving ads:
    • Remarketing-related data
    • Data related to reporting on displayed ads

  The above data is obtained through Google Analytics script and is anonymous.

• Data collected during registration:

  • Username, first and last name, email address

  In the case of logged-in Users (having an account in the Service), the User identifier associated with the User's account may be placed in cookie files stored on the User's device.

• Data collected when subscribing to the newsletter:

  • email address

VIII. Copyright

• The owner of the Service and copyrights to the service is the Service Provider.
• Part of the data posted in the Service is protected by copyrights belonging to companies, institutions and third parties, not related in any way to the Service Provider, and is used on the basis of obtained licenses, or based on free license.
• Based on the Act of February 4, 1994 on copyright, it is prohibited to use, copy, reproduce in any form and store in search systems except for Google, Bing, Yahoo, NetSprint, DuckDuckGo, Facebook and LinkedIn search engines any articles, descriptions, photos and all other content, graphic materials, video or audio found in the Service without written consent or consent provided via Electronic Communication from their legal owner.
• In accordance with the Act of February 4, 1994 on copyright, simple press information, understood as information itself, without comment and evaluation by its author, is not subject to protection. The author understands this as the possibility of using information from texts posted in the service, but not copying all or part of articles unless this has been marked in a particular material made available in the Service.

IX. Terms Changes

• All provisions of the Terms may be unilaterally changed by the Service Provider at any time, without giving reasons.
• Information about the change of Terms will be sent electronically to Users registered in the Service.
• In case of Terms changes, its provisions come into effect immediately after publication for Users who do not have an account in the Service.
• In case of Terms changes, its provisions come into effect with a 7-day transition period for Users who have accounts in the Service registered before the Terms change.
• It is considered that every User who continues to use the Service after the Terms change accepts it in full.

X. Final Provisions

• The Service Provider is not responsible in any way, as permitted by applicable law, for content transmitted and published in the Service by Users, for their truthfulness, reliability, authenticity or legal defects.
• The Service Provider will make every effort to ensure that Service services are offered continuously. However, it bears no responsibility for disruptions caused by force majeure or unauthorized interference by Users, third parties or the activity of external automatic programs.
• The Service Provider reserves the right to change any information posted in the Service at a time chosen by the Service Provider, without the need to notify Users using the Service's services in advance.
• The Service Provider reserves the right to temporarily, completely or partially disable the Service to improve it, add services or perform maintenance, without prior notice to Users.
• The Service Provider reserves the right to permanently disable the Service without prior notice to Users.
• The Service Provider reserves the right to make an assignment in part or in whole of all its rights and obligations related to the Service, without the consent and possibility of expressing any objections by Users.
